Terms and Conditions

1. General
1.1 These terms and conditions govern all electrical installation and maintenance work carried out by Evans Electrical Services ("the Company"). By engaging our services, the customer ("the Client") agrees to these terms.

2. Warranty
2.1 We offer a 12-month parts and labour warranty on all work carried out by our electricians, except where stated otherwise.
2.2 If a fault arises due to defective workmanship within this period, we will rectify the issue free of charge.
2.3 The warranty does not cover issues caused by misuse, tampering, or third-party interference.
2.4 If the Client provides their own materials, we cannot offer any warranty on the parts, and investigation work due to failure will be chargeable.

3. Pricing and Payments
3.1 All invoices are due for payment upon completion of the work unless otherwise agreed in writing.
3.2 If payment is not received within 30 days of the invoice date, a 3% increase will be applied for every additional 7 days the invoice remains unpaid.
3.3 Interest on overdue invoices will be charged at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
3.4 Unpaid debts after 30 days will be referred to a debt recovery agency, with additional recovery costs passed to the Customer.
3.5 We charge a first-hour rate that covers travel and expenses, followed by an hourly rate for each additional hour.
3.6 Out-of-hours work (Monday-Friday 5:00 PM – 8:00 AM, weekends, and public holidays) is charged at a higher rate.
3.7 If this contract is formed remotely (e.g., via phone or email), the Client may have a 14-day cooling-off period in accordance with the Consumer Contracts Regulations 2013. This does not apply to urgent or emergency works.
3.8 The Company reserves the right to withhold test certificates until full payment is made. This does not affect the Client’s statutory rights to a functional installation.

4. Quotations and Estimates
4.1 All quotations are provided free of charge unless investigation work such as fault finding is required, in which case this will be chargeable.
4.2 Estimates are provided based on the initial assessment of the work. If unforeseen complexities arise, additional charges may apply. However, no additional charges will be incurred without prior agreement from the Client.
4.3 Unless explicitly stated in the quote, we do not include making good or redecoration work after installation. This includes but is not limited to plastering, painting, redecoration, and the lifting and relaying of flooring or carpets. If such work is required, it will be the Client’s responsibility to arrange for it separately unless explicitly included in our quotation.

5. Client Responsibilities
5.1 The Client is responsible for providing clear and accurate specifications, including designs and drawings where applicable.
5.2 The Client must ensure clear and unrestricted access to the work area at the agreed-upon time. If access is unavailable, a first-hour charge will apply.
5.3 If the work area is not clean or clear, the Client may be liable for additional costs to accommodate delays or additional labour.

6. Materials
6.1 All materials supplied by the Company remain the property of the Company until full payment has been received.
6.2 Upon delivery, the risk for materials passes to the Client, who is responsible for their safekeeping.

7. Liability and Limitations
7.1 The Company is not liable for delays caused by unforeseen circumstances, third-party involvement, or access restrictions.
7.2 We are not responsible for any loss, damage, or costs incurred due to faulty materials supplied by the Client.
7.3 Any pre-existing electrical faults or issues discovered during our work will be reported to the Client, and additional work to rectify them will be chargeable.

8. Cancellations and Rescheduling
8.1 If the Client needs to cancel or reschedule an appointment, at least 48 hours’ notice must be given. Failure to do so may result in a cancellation fee equivalent to the first-hour charge.
8.2 The Company reserves the right to cancel or reschedule appointments due to unforeseen circumstances such as emergencies, illness, or adverse weather conditions.

9. Health and Safety
9.1 The Client must ensure a safe working environment for our electricians.
9.2 We reserve the right to halt work if conditions are deemed unsafe, and any delays caused by unsafe working conditions may result in additional charges.

10. Use of Photographs for Marketing
10.1 The Company may take photographs of completed installation work for marketing and promotional purposes.
10.2 If the Client does not wish for images of their property to be used, they must notify the Company in writing before work commences.

11. Force Majeure
11.1 The Company shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to natural disasters, acts of war, terrorism, strikes, supply chain disruptions, or governmental actions.
11.2 If a force majeure event occurs, the Company will notify the Client as soon as possible and take reasonable steps to mitigate any disruption.

12. Data Protection
12.1 The Company complies with all applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
12.2 Any personal data collected from the Client will be used solely for the purpose of providing services, processing payments, and maintaining customer records.
12.3 The Company will not share the Client’s personal data with third parties without explicit consent unless required by law.
12.4 The Client has the right to request access to, correction of, or deletion of their personal data held by the Company.

13. Governing Law
13.1 These terms and conditions are governed by the laws of England and Wales.
13.2 Any disputes arising from these terms shall be resolved in the appropriate legal jurisdiction.
